Refund Policy

This Refund Policy applies to TDismiss document preparation services for eligible T Defense Service orders. It explains when a refund may apply, how refund amounts are calculated, and what proof is required.

1. Scope

This policy applies only to:

  • T Defense Service document preparation service
  • Orders for the base standard service

This policy does not apply to:

  • Court fines
  • Court bail
  • Court trial fees
  • Trial De Novo appearance fees
  • Administrative handling fees
  • Rush or expedited fees
  • Upgrades or add-on services

Rush or expedited fees are deemed fully earned upon payment and are non-refundable.

2. Refund Eligibility

This policy applies to orders paid on the TDismiss website for T Defense Service document preparation.

If an order is canceled before document preparation begins because the case does not meet service requirements, the document preparation fee paid for that order will be refunded in full.

3. Order Cancellation Rules

Once payment is completed, the order enters service preparation.

A customer may request cancellation and receive a full refund if both conditions are met within 15 minutes after payment:

  • The refund request is submitted within 15 minutes after payment.
  • The document package has not yet been generated, produced, delivered, or made available for download.

After 15 minutes, or once document generation or production has started, or once downloadable content has been provided, the order cannot be canceled for personal reasons. Any refund will then be governed only by the other terms of this policy.

4. Partial Refund Rules

A partial refund may apply if the final result does not dismiss the case but does reduce the court fine.

Refund formula:

Refund amount = document preparation fee paid - amount of fine reduction

If the amount of fine reduction is equal to or greater than the service fee paid, no refund is due.

For this calculation, the amount of fine reduction is determined solely by the final monetary fine shown in the court's final ruling document.

The calculation does not include DMV points, insurance impact, future risk, or the customer's time cost.

The guiding principle is that, based on fine amount only, the customer's result should not be worse than simply paying the fine directly.

5. Conditions for a Full Refund

A full refund is available only if all of the following conditions are satisfied:

  1. The customer submitted the T Defense Service document package prepared by TDismiss to the court.
  2. The final case result was not dismissed.
  3. The court fine was not reduced.
  4. The customer provides complete, clear, and verifiable official court outcome documents, such as a TR-215, Minute Order, or Court Docket.
  5. The refund request is submitted through the TDismiss website within 30 calendar days from the filed date shown on the court outcome document.

Refund scope: only the document preparation service fee actually paid, excluding rush fees.

Refund timing: once approved, TDismiss initiates the refund to the original payment method within 5 to 10 business days. Actual posting time is determined by the payment provider and your card issuer or bank. A different refund account is not supported.

6. Non-Refundable Situations

No refund will be issued in any of the following situations:

  • The customer did not actually submit the document package.
  • The court rejected the filing because the customer missed the deadline.
  • The refund request was submitted more than 30 calendar days after the relevant court document date.
  • Document preparation was completed but the customer chose not to submit it.
  • No valid court outcome document was provided.
  • The documents submitted were incomplete or could not be verified.
  • False, forged, or altered materials were provided.
  • The customer affirmatively chose Guilty or No Contest.

TDismiss may request supplemental documents for an incomplete claim. A claim is finalized after TDismiss issues a final decision under this policy. TDismiss reserves the right to verify claims against public court records.

7. Alternative Remedy for Guilty or No Contest Pleas

If the customer chooses Guilty or No Contest, no cash refund will be issued.

Instead, the customer may request one of the following within 30 days:

  • A discount on document preparation service for one future case
  • One free base service for one future case

This is an alternative remedy only. It is non-transferable, cannot be redeemed for cash, and cannot be combined with other offers.

8. Quality and Process Protection

If any of the following occurs, the customer is eligible for either (i) a full refund of the document preparation fee, or (ii) one free remake, as determined by TDismiss based on the issue type:

  • The court rejects the filing because of a document formatting defect attributable to TDismiss.
  • The case cannot be accepted because of an operational error attributable to TDismiss.
  • TDismiss fails to deliver the document package within the promised timeframe.

This protection is independent of the final court outcome.
